These general terms and conditions of sale govern the relationship between, on the one hand, oummimuslim.com and, on the other hand, the person who makes a purchase through the oummimuslim.com website.

Please ensure you have read and understood our terms and conditions of sale before placing your order. We reserve the right to modify these terms and conditions from time to time without prior notice to you. The version of the terms and conditions of sale that will apply to your order will be the one appearing on the oummimuslim.com website at the time you place your order.

ARTICLE 1 – PRICE

1.1 – Product prices are indicated in euros, all taxes included, excluding shipping costs.

1.2 – All orders, regardless of their origin, are payable in Euros.

1.3 – oummimuslim.com reserves the right to modify its prices at any time. Products are invoiced based on the prices in effect at the time the order is confirmed.

ARTICLE 2 – ORDER

2.1 – The Customer declares to have read and accepted these general conditions of sale before placing the order.

2.2 – The Parties mutually acknowledge that the products presented on the website www.oummimuslim.com may no longer be available or on sale at the time of the order.

2.3 – When registering data in the “my account” section, the Client must ensure the accuracy and completeness of the mandatory data he provides.

2.4 – Only persons legally capable of entering into contracts concerning the goods and services offered on the site may order on the site oummimuslim.com

2.5 – oummimuslim.com reserves the right to suspend or close the account of any customer who violates the provisions of the general terms and conditions of sale. Any person whose account has been suspended or closed may not subsequently place orders on the oummimuslim.com website without prior authorization.

ARTICLE 3 – VALIDATION OF THE ORDER

3.1 – A confirmation email summarizing the order (products, price, quantity, etc.) will be sent to the customer by oummimuslim@gmail.com

3.2 – The product sales contract will be concluded when the Customer, after having had the opportunity to check the details of his order and its total price, as well as to correct any errors, confirms it to oummimuslim.com to express his definitive acceptance of the quote or order form.

3.3 – Any order confirmed by the Customer constitutes conclusion of the sales contract and, correlatively, acceptance of the prices, description, quantity of the products available for sale and the clauses contained in these general conditions of sale.

3.4 – The data recorded and stored by oummimuslim.com constitutes proof of all transactions between oummimuslim.com and its customers.

3.5 – An order is considered validated only after receipt of payment.

3.6 – Once the order has been validated, no modification or cancellation is possible.

ARTICLE 4 – DELIVERY

4.1 – oummimuslim.com strives to ensure deliveries within 7 working days for Metropolitan France.
+ 7 working days for shipments outside France from the date of payment of the order. The times indicated are usual average times and correspond to processing and delivery times.

4.2 – oummimuslim.com undertakes to inform the Customer of any foreseeable delay in delivery.

4.3 – The products are delivered to the address indicated when ordering the products or to the selected relay point. In the event of an error on the part of the customer regarding their address, this is not the responsibility of the Oummi Collection company, so the shipping costs are the responsibility of the customer and are not refundable.

4.4 – Ownership of the goods and the risks relating thereto are transferred to the customer upon taking possession of them.

4.5 – The Customer may only make reservations upon delivery of the Products in the event of delivery not conforming quantitatively to the order.

4.6- In the event of non-conformity of the products with the order, the Customer must send an email to oummimuslim.com to dispute this.
oummimuslim.com will refund the products following their prior return. The request must be made within three (3) working days following the date of receipt of the products. Any claim made outside this period will not be accepted. The products must be returned to oummimuslim.com in the condition in which the Customer received them, intact and in their original packaging. Shipping costs will be borne by the Customer.

ARTICLE 5 – PAYMENT

5.1 – Payment by credit card (Paypal or Stripe)

5.2- The Customer can pay online by credit card via the secure payment module Paypal or Stripe. The credit card number and expiration date are encrypted and transmitted to Paypal or Stripe securely (SSL) without oummimuslim.com or third parties having access to them.

5.2 – The amount of the order is debited from the Customer’s account at the time of payment validation.

5.3 – The data recorded and stored by oummimuslim.com constitutes proof of the order and all transactions made. The data recorded by the payment system constitutes proof of financial transactions.

5.4 – The order, subject to availability, will be sent to the Customer upon receipt of payment by oummimuslim.com

5.5 – Invoices are issued by email when ordering and available upon request by email.

ARTICLE 6 – GUARANTEE / LIABILITY

6.1. – The products comply with French legislation.

6.2 – oummimuslim.com cannot be held liable in the event of stock shortages, late delivery, strikes (including in transport) or force majeure and, more generally, for any event not exclusively and directly attributable to it.

6.3 – The photographs illustrating the products on the oummimuslim.com website are not contractual. The OUMMI COLLECTION company strives to provide photos that are as accurate as possible of the items, but slight color variations are sometimes possible.

6.4 – We strive to supply a large quantity of fabric and we cannot guarantee that the shades according to the rolls of fabric are identical, therefore the colors of the items may vary slightly from the photos.

6.5 – The Customer accesses, uses and browses the oummimuslim.com website at his or her own risk.

6.6 – oummimuslim.com has, for all stages of access to the site, the ordering process, delivery or subsequent services, only an obligation of means. oummimuslim.com cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, an external intrusion, the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.

6.7 – The Customer acknowledges and accepts that, to the fullest extent permitted by applicable regulations, oummimuslim.com cannot be held liable for direct, indirect, incidental damages, or compensation for moral prejudice, costs, losses, reduction in turnover or profits, or liabilities of any nature whatsoever (even if the occurrence of such damage was known or could have been foreseen by oummimuslim.com ), which may arise from the use or, on the contrary, the impossibility of using the site or its content.

ARTICLE 7 – REIMBURSEMENT

7.1 For any complaint, an email must be sent to the following address: oummimuslim@gmail.com

7.2 The outward/return shipping costs remain the responsibility of the customer.

7.3 Returns must be made within 14 working days of receipt. After this period, NO returns or claims will be considered.

7.4 We do not issue refunds on items that do not have any obvious defects or errors on our part.

7.5 In case of dissatisfaction, size error or any other problem not directly involving the Oummi Collection company, you have 14 working days to return the items and obtain a refund (in the form of a credit note ONLY).

7.6 Returns of items in Seine et Marne (France) via Mondial Relay or Colissimo, in the event of loss on the part of the carrier during the return of items , the responsibility of the company Oummi collection cannot be engaged. And compensation will be the responsibility of the carrier.

7.7 Returns must be made as follows:

– The item must be in its original packaging (in good condition).

– The PDF invoice that the customer will have printed must be attached.

– In the event of a return via Mondial Relay, the package must be returned to the relay point indicated in the return procedure email sent by customer service.

– Returned items must be intact and unworn except for fitting. (items must not contain perfume, makeup, hair, dust or other)

– A deduction of three euros per returned package is applicable due to the handling carried out and the various costs to which the Oummi collection company is subject.

If these conditions are not met, the Oummi collection company reserves the right to return the items to the customer without compensation at the customer's expense.

ARTICLE 9 - PERSONAL DATA

oummimuslim.com is committed to protecting the personal data provided by the Customer. All personal data concerning the Customer collected by oummimuslim.com is treated with the strictest confidentiality, in accordance with the provisions of the personal data protection policy.

ARTICLE 10 - CLICK COLLECT

Click & Collect orders are to be collected from Noisiel. Payment must be made in advance on the website. If the customer subsequently wishes to cancel, they will receive a credit note for the amount of their order.

ARTICLE 11 - RETURNED ORDER

11.1 - In the event that the customer does not collect his order within 7 days at the relay point, and that the same order is subsequently returned to the company Oummi Collection. The customer will receive by email a refund in the form of a credit note within 72 hours once the order has been received by the company Oummi Collection. As this situation is not the responsibility of the company Oummi Collection, the refund does not include the shipping costs initially paid by the customer.

11.2 - The return costs incurred by the company only concern parts with proven defects; the company does not cover returns for reasons of simple exchange. These must be sent separately and remain the responsibility of the customer. In the event of non-compliance with this instruction, a deduction for the amount of the costs incurred will be made.
